If you are obtaining a quote for and/or securing or procuring travel for more than just yourself, all references below to “I” (and derivations thereof, including without limitation “my” and “me”) shall be read to mean you on behalf of yourself and each individual within your group for whom you are obtaining a quote and/or securing or procuring travel.
TERMS AND CONDITIONS
I understand that Luxe It Travel, and its affiliates ("LIT") is not the source or supplier of the travel services I have requested and acts solely as an agent for the actual suppliers of such services. I have been advised that the suppliers whose names appear in the information supplied to me are those who are responsible for providing the travel services I have purchased. I consent to, request the use of those suppliers, and agree not to hold Luxe It Travel and its affiliates responsible should any of these suppliers: 1) fail to provide the travel services I have purchased; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission that causes me any sort of injury, damage, delay or inconvenience.
I accept that Luxe It Travel, and its affiliates is not responsible for, nor will I attempt to hold it liable for, any injury, damage, or loss I may suffer on account of any conditions, actions, or omissions that are beyond its reasonable control. Accepting only liability that directly arises from the gross negligence or willful misconduct of Luxe It Travel and its affiliates (proven in a court of law), I will not hold it responsible for any injury, damage, or loss I may suffer while on any third party provided or operated excursion or activity.
I understand that by agreeing to receive services through Luxe It Travel and its affiliates I hereby agree to hold harmless and indemnify Luxe It Travel and its affiliates , and all those (directly/indirectly) associated with either party against any and all damage, liability, claims, demands, expenses, actions, costs, and loss, as well as legal fees and costs incurred, as a result of the Services, rendered this Agreement or any transaction or matter connected with the Services or the relationship between Contractor, myself the client, and Luxe It Travel and its affiliates . This clause shall not be read to provide indemnification for any Party if a competent court of law, rendering a final judgment, holds that the bad faith, gross negligence, or willful misconduct of the Party caused the damage, liability, or loss.
I understand that it is my responsibility to review my travel documents for accuracy upon receipt and understand that I may contact Luxe It Travel and its affiliates if I have any questions. I also understand that if changes are needed that they must be completed by the time indicated or I may be subject to additional fees for Luxe It Travel and its affiliates and/or travel vendors/suppliers.
I understand that it is my responsibility to review the accuracy of all details in the travel quotes provided to me and to confirm the same to Luxe It Travel and its affiliates within the time indicated I may be subject to additional fees Luxe It Travel and its affiliates and/or travel vendors.
I understand that all reservation fares typically involve restrictions (including, but not limited to, restrictions related to cancellation, change fees, etc.) and that changing any aspect of my travel arrangements may result in the payment of additional money and/or fees.
I understand that the Transportation Security Administration (TSA) requires me to carry a government-issued identification card in order to board a domestic flight. I have been advised that the name, date of birth, and gender that appear on the identification card must exactly match the same data that is listed on my airline ticket and in my booking records. I acknowledge that my failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing me to miss my flight.
I understand that if traveling internationally, I must have a valid passport (i.e. valid passport means travel dates are at least 6 months from passport expiration), and depending upon my destination and nationality, I may need to obtain one or more visas. I assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of my destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). I also acknowledge that while some cruise suppliers may allow me to travel without a valid passport, it is the recommendation of Luxe It Travel and its affiliates that all travelers obtain and travel with a valid passport.
I understand that Luxe It Travel, and its affiliates has no special knowledge regarding the financial condition of travel service providers selected for your travel services, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. For information concerning possible dangers at destinations, Luxe It Travel, and its affiliates recommends contacting the Travel Warnings Section of the U.S. State Department at 1-888-407-4747 or www.travel.state.gov. For medical information, Luxe It Travel, and its affiliates recommend contacting the Centers for Disease Control at 1-800-232-4636 or www.cdc.gov/travel. I assume full responsibility for participating in all travel services. Luxe It Travel and its affiliates will not be held responsible for the contraction of diseases (ie. COVID-19), illness, and/or death that occurs while on a scheduled booking. As a traveler, I accept all possibilities of injury, illness, and death.
I understand that all bookings will be disseminated to me, the client, on the day of booking, I understand after receiving the booking emails that I will be given a set time period to verify any and all information to assure against errors. I understand that it is my responsibility to notify the travel agent making the booking of the needed changes within the set time period. I understand that if I do not notify the travel agent the booking will be submitted as is and any further changes after the deadline will result in additional fees from the travel agency and/or booking sites.
I understand that by accepting services conducted by Luxe It Travel and its affiliates and their associates I agree to hold harmless and indemnify the company and all those (directly/indirectly) associated with either party against any and all damage, liability, claims, demands, expenses, actions, costs, and loss, as well as legal fees and costs incurred, as a result of the travel services rendered, this Agreement or any transaction or matter connected with the services rendered or the relationship between Client, agent, and travel agency. This clause shall not be read to provide indemnification for any Party if a competent court of law, rendering a final judgment, holds that the bad faith, gross negligence, or willful misconduct of the Party caused the damage, liability, or loss.
I understand that Luxe It Travel, and its affiliates will make every effort to ensure that the Client understands all services rendered before and after bookings are made. LIT will also make every effort to render quality travel-related services. However, we do not guarantee 100% satisfaction before, during, and after post-travel arrangements have been made. Luxe It Travel and its affiliates takes no responsibility for inaccuracies, delays, cancellations, or the inability of a client to effectively participate in services.
I understand that Luxe It Travel, and its affiliates provide no refunds or warranties as to the function of services rendered and retained by the Client whether express, implied, or statutory. If a refund is requested, or a trip cancellation occurs the Client understands that refunds will be subject to the policies of the vendor. Agreeing to use these services also means that the Client accepts all responsibility for any risk thereof this may include but is not limited to medical expenses, funeral expenses, or legal actions taken by yourself and anyone associated with you.
I understand that by purchasing services (either for myself or those in my party) from Luxe It Travel and its affiliates I am waiving my right, the right of my (and all those in my party) heirs, family, friends, colleagues, or any particular person(s) associated with me, or my company to take legal, fiscal, or other actions against me due to accidental or negligence by anyone associated with Luxe It Travel and its affiliates (such as but not limited to the owner, employee, consultant, contractor, family, friend, a sister company, and/or partner companies, etc.) anyone associated with Luxe It Travel and its affiliates .
I understand that the Company is not liable to Client or any third party for consequential, indirect, special, or exemplary damages including but not limited to damages for loss of life, sickness, illness, profits, business, or anticipated benefits whether arising under tort, contract, negligence or otherwise whether foreseen, reasonably foreseeable or advised of the possibility of such damages. I relinquish my right, the rights of those in my party, my family, friends, heirs, and all those associated with me now and in the future to take legal actions against Luxe It Travel and its affiliates, their partners, employees, associates, sister businesses, and all those associated with them.
I understand that Luxe It Travel and its affiliates HIGHLY recommends the purchase of travel insurance to cover foreseen/unforeseen events like supplier bankruptcy, missed flights, traffic delays, loss of baggage, or the inability to travel due to a medical or personal emergency. I understand that if I choose not to purchase travel insurance I accept all liability and will hold harmless Luxe It Travel and its affiliates for all foreseen/unforeseen events.
I agree that where Travel and its affiliates has identified the same in a written communication to me (including via email), a deposit may be required, and/or certain itinerary planning charges may be imposed. In addition, each booking is subject to a planning/booking fee. All payments (monies) are due upon invoice receipt and must be paid before the booking is complete. If the trip is not booked, or if a booked trip is canceled, the deposit would be forfeited and would become compensation to Travel and its affiliates for the work associated with the searching, planning, and communication of activities.
I also understand that if I choose to cancel a portion of my trip, I may be subject to the loss of all and/or a portion of my trip fees initially described in the invoice. Custom itinerary planning fees may be charged for multi-destination trips and trips that include the coordination of multiple modes of transportation (e.g., flights, trains, ground transfers, etc.).
I understand that Luxe It Travel, and its affiliates typically doesn't arrange trips within a timeframe of fewer than 30 days from the departure date. However, on occasion, such bookings may be made at the company's discretion and may incur additional fees.
I understand that I may be subject to an additional fee (per person) if I or individuals within my party fail to pay the agreed-upon deposit within 24 hours of receiving the initial invoice. I also understand that I may be subject to an additional fee (per person) for additional modifications and changes to already confirmed reservations plus the rates of all suppliers/vendors. These charges will be imposed only if advised in writing (including via email) by Luxe It Travel and its affiliates.
I understand that prices are subject to change without notice because of the unpredictable variability in travel prices. PAYMENTS SHOULD BE MADE VIA the company's established payment portal unless otherwise stated in writing. Full payments are typically required upon receipt of the invoice unless otherwise stated in writing and agreed upon by both parties. Payment plans can be made using the company's established payment portal only.
I understand that prices are subject to change and those listed on the invoice are only estimates until the time of booking. In the event that prices fluctuate upwards, I recognize that it is my responsibility to pay any price differences. However, if prices fluctuate downwards Luxe It Travel and its affiliates will return any differences.
LODGING
I understand that upon arrival I may be responsible for providing a card for incidentals.
I understand that I am responsible for any damages and/or property violations incurred at the rental property (hotel, resort, etc.) caused by me or anyone at my party during my stay. While Luxe It Travel and its affiliates will do their best to ensure that all requirements for occupying the property are clearly stated, ultimately, I understand that it is my responsibility to be aware of and follow all property requirements.
Please note that as a result of third-party rules and policies we are unable to book Airbnb, VRBO, or vacation homes on the behalf of the client. We are more than happy to locate your desired property for an additional fee.
FLIGHT
I understand that many airlines now have adjusted baggage policies that only allow travelers to bring one personal item (usually the size of a backpack) if a basic ticket is purchased. Unless otherwise stated in writing Luxe It Travel and its affiliates will not book baggage or other extra services offered by the airline. I understand that this is my responsibility and will not hold Luxe It Travel and its affiliates responsible for baggage or other service charges.
I understand that many airlines now require masks to be worn throughout the duration of the flight and at the airport. In some cases, negative COVID-19 tests are required to fly. I understand that this is my responsibility to know the details of the flight requirements and will not hold Luxe It Travel and its affiliates responsible for any adverse impacts on my trip.
ACTIVITIES: Reservations made at restaurants, excursions, etc.
In the event that Luxe It Travel and its affiliates book an activity on my and my parties’ behalf, I understand that I am participating in these activities at our own risk. Luxe It Travel and its affiliates is not liable for any consequential, indirect, special, or exemplary damages including but not limited to damages for loss of life, sickness, illness, profits, business, or anticipated benefits whether arising under tort, contract, negligence or otherwise whether foreseen, reasonably foreseeable or advised of the possibility of such damages incurred while participating in activities. I relinquish my right, the rights of those in my party, my family, friend, heirs, and all those associated with me now and in the future to take legal actions against Luxe It Travel and its affiliates their partners, employees, associates, sister businesses, and all those associated with them.
The laws of the State of Louisiana govern the rights and obligations of the parties to this Agreement and the interpretation, construction, and enforceability thereof. I agree that any action or proceeding brought by me against LIT shall be brought solely in the courts of Louisiana located in Tangipahoa Parish. In the event any action or proceeding is initiated by me in a court outside of Tangipahoa Parish, Louisiana, I agree to pay LIT's costs and reasonable attorney fees associated with defending such action or proceeding.
The Client Agreement
I understand that Luxe It Travel and its affiliates requires that all members of the participating party receiving services from Luxe It Travel and its affiliates complete and sign this agreement. In the event that the form is not completed. I understand that the moment Luxe It Travel and its affiliates book and/or receive payment for a booking on my behalf I am agreeing to all of the points outlined in this service agreement.
I understand that this agreement is subject to change at any time without notice. While Luxe It Travel and its affiliates will do its best to update this agreement on its website when changes are made, I understand that it is my sole responsibility to ensure that I have the most updated version of the agreement upon booking and receiving services.
